1.2. These Terms and Conditions apply whenever you use our FT Communities websites and online digital apps and services (together “FT Community Platform”) and access the content and services available on them (together, the “FT Content”).
1.3. You should read these Terms and Conditions carefully before using the FT Community Platform. By accessing or using our websites and online digital apps and services, you agree to be bound by these Terms and Conditions (as applicable) and the documents referred to in them.
1.4. If you have been given access to the FT Community Platform under a membership, subscription or other agreement that you or your organisation has with us or one of our affiliates, then your access is primarily governed by that agreement. In the event of any conflict between these Terms and Conditions and that agreement, the terms of that agreement shall prevail to the extent of the inconsistency only. 2.1. The FT Community Platform and FT Content (other than your own UGC, as defined below) and all intellectual property rights in each are owned by us, our licensors or both (as applicable). Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We reserve all of our rights in any intellectual property in connection with these Terms and Conditions. This means, for example, that we remain owners of them and free to use them as we see fit.
2.2. Nothing in these Terms and Conditions grants you any legal rights in the FT Community Platform or the FT Content other than as necessary to enable you to access and use the FT Community Platform. You agree not to adjust, to try to circumvent or delete any notices contained on the FT Community Platform (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the FT Community Platform.
2.3. “FT” and “Financial Times” are registered trade marks, and you may not use them without written permission from FT.
2.4. You are permitted to use the FT Content only as set out in our Copyright Policy (in which references to FT.com should be read as to the FT Community Platform), provided that nothing in these Terms and Conditions or our Copyright Policy is intended to limit your use of your own UGC (as defined below), to the extent this becomes “FT Content” by virtue of being posted or published on the FT Community Platform.
2.5. You agree to comply with our Copyright Policy when using FT Content. You are responsible for your use of FT Content, whether you have purchased a product or service from us yourself or are accessing the FT Community Platform under your organisation’s membership, subscription or other agreement.
2.6. The amount and types of FT Content that you can access will vary depending on the membership, subscription or other agreement that you or your organisation has with us. We may vary or cancel your access at any time.
2.7. On registration as a user of the FT Community Platform, you will choose a user name and password (“ID”). It is your responsibility to keep your ID confidential. The email address must not correspond to a generic or shared email account, and you must be entitled to use that e-mail address. All information received by us from your use of FT Content will be used by FT in accordance with our Privacy Policy.
2.8. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information, you must notify FT immediately by e-mailing us at forums@ft.com. We recommend that you do not use a “Remember me” log in feature on any device that may be used by anyone other than you in order to prevent unauthorised access to the FT Community Platform and your personal profile and details.
2.9. The FT Community Platform includes networking, commenting and other features that allow interaction between users. If you post information or content directly to the FT Community Platform or make information or content available to us for publication on the FT Community Platform (“User Generated Content” or “UGC”) then you must comply with these Terms and Conditions and any specific rules or guidelines posted on the FT Community Platform. You are responsible for all the content of any of your UGC that you or we publish. You are financially responsible to us for any claim against us by any third party that your UGC is not in accordance with these Terms and Conditions or that otherwise relates to your UGC.
2.10. You own the copyright in your UGC, and you agree to grant FT an irrevocable right (but not an obligation) unlimited in time to publish, re-use, archive, modify, delete or commercially exploit that UGC in whole or in part as we see fit, whether on the FT Community Platform or otherwise, without any requirement to pay you for this and with or without attribution to you. You also waive any moral rights that you may have in regard to the UGC.
2.11. You agree that you will:

It is not possible for FT to fully monitor all UGC published on the FT Community Platform but where we have actually received notice of any UGC that is potentially misleading, untrue, offensive, unlawful, infringes third party rights or is potentially in breach of these Terms and Conditions, then we will review that UGC, decide whether to remove it from the FT Community Platform and act accordingly. This may include banning a user from participation in UGC on the FT Community Platform. If you are aware of any such UGC, please notify us immediately with specific details by contacting us at forums@ft.com.
2.13. We can link your UGC, including anything posted under a pseudonym, to your ID. We may contact you from time to time regarding your UGC.
2.14. While we try to make sure that all FT Content published by us is accurate, up-to-date and free from bugs, we cannot promise that it will be. Furthermore, we cannot promise that the FT Community Platform will be fit or suitable for any purpose. Any reliance that you may place on the information on the FT Community Platform is at your own risk.
2.15. The FT Content is provided for your general information purposes only and is not intended to address your particular requirements. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes.
2.16. We may suspend or terminate operation of the FT Community Platform or any part thereof at any time as we see fit.
2.17. While we try to make sure that the FT Community Platform is available for your use, we do not promise that the FT Community Platform is available at all times nor do we promise the uninterrupted use by you of the FT Community Platform.
2.18. The FT Community Platform may contain hyperlinks or references to third party websites and third party products. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any products, content, material or information contained in them. The display of any hyperlink and reference to any third party website or third party product (including any advert or sponsor) does not mean that we endorse that third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.
2.19. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to/from) the FT Community Platform are at your own responsibility and entered into at your own risk.
3.1. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information.
4.1. Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, and without limiting any liability we may have to you or your organisation under any other agreement between us (which shall be governed by that agreement), we are not legally responsible for any of the following which may arise from or in connection with your use of the FT Community Platform:
4.2. The limitations of liability in this section 4 apply for the benefit of FT, its affiliates, and all of their respective officers, directors, employees, agents or any company who we transfer our rights and obligations to in accordance with these terms and conditions.
5.1. If you are a user whose principal address or principal use of the FT Community Platform occurs in any jurisdiction other than the United States then these Terms and Conditions will be subject to English law. In this case, to the extent possible in the applicable jurisdiction, both you and we agree that the courts of England will have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and Conditions.
5.2. If you are a user whose principal address or principal use of the FT Community Platform occurs in the United States then these terms and conditions will be subject to the laws of the State of New York, without regard to its conflict of laws provisions. In this case, to the extent possible in the applicable jurisdiction, both you and we agree that the courts of the State of New York will have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and Conditions.
6.1. We shall have no liability to you for any breach of these Terms and Conditions caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; epidemic or pandemic; breakdown of systems or network access; or flood, fire, explosion or accident.
6.2. You may not license or transfer any of your rights under these Terms and Conditions. We may transfer any of our rights or obligations under these Terms and Conditions to any company within the Financial Times group of companies, but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.
6.3. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which will remain in full force and effect.
6.4. Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy. Headings in these Terms and Conditions are for convenience only and will have no legal meaning or effect.
6.5. These Terms and Conditions (together with the terms of any membership, subscription or other agreement that you or your organisation has with us or one of our affiliates under which you are given access to the FT Community Platform) constitute the entire agreement between you and the FT relating to your use of the FT Community Platform. They supersede all previous communications, representations and arrangements, either written or oral.
7.1. These Terms and Conditions were published on 1 March 2022.
7.2. We may update these Terms and Conditions for legal or regulatory reasons, or to reflect changes in our services or business practices. We will provide notice of any significant changes below. You should regularly check this section to see if any changes have been made.
